In the Matter of the Appeal of the Trespass Citations Issued to Roger Richard Walz and Paul Thomas Arens.

PREHEARING ORDER

A prehearing conference was held by telephone on February 19, 2002. Conservation Officer Dave Rodahl, Roger Richard Walz and Paul Thomas Arens participated. There was a short discussion of the circumstances surrounding the issuance of the civil citation, and an agreement by the parties that the matter would be handled through written submissions to the administrative law judge.

IT IS HEREBY ORDERED:

1. Officer Rodahl, Mr. Walz and Mr. Arens will each submit a written explanation of the circumstances that surrounded the issuance of the citation on November 3, 2001. Each letter shall be mailed to the administrative law judge no later than March 4, 2002. Each party shall also provide a copy to the other parties. Copies for Officer Rodahl may be mailed to the administrative law judge who will forward them.

2. The matter will be decided on the basis of the written submissions and review of the applicable law.

3. By agreement of the parties, no hearing will be held.
