Dear Counsel:
This letter constitutes the First Prehearing Order in the above matter regarding our discussions during the prehearing conference held August 18, 2010. Mr. Tostengard appeared for the Department of Labor and Industry (Department); Ms. Baudler appeared for U.D. Construction, Inc., and Nicholas R. Uhde (Respondents). The parties advised the Administrative Law Judge that this matter will likely settle in the next few weeks. If it does not, Mr. Tostengard will forward to me a proposed Protective Order that would allow disclosure of the Department’s investigative file to Ms. Baudler. Ms. Baudler should advise me of any objections within one week of receipt. We set the following schedule:
•October 21, 2010: Deadline for exchanging all exhibits the parties intend to offer into evidence at the hearing, along with a witness list containing a brief summary of the anticipated testimony of each witness. Please send a copy of the exhibit and witness lists to me at this time.
•October 28, 2010: Hearing, commencing at 9:30 a.m. at the Office of Administrative Hearings.
