Dear Counsel:
This letter constitutes the First Prehearing Order in the above matter regarding our discussions during the prehearing conference held June 15, 2010. Mr. Tostengard appeared for the Department of Labor and Industry; Mr. Jacobberger appeared for Paragon Builders, Inc., and Ronald Engen (Respondents). Mr. Engen also attended the prehearing conference. Mr. Tostengard indicated that he would provide a proposed protective order, and Mr. Jacobberger agreed to notify me if he had any objections to it within two to three days of receipt. We set the following deadlines:
•September 2, 2010: Deadline for exchanging all exhibits the parties intend to offer into evidence at the hearing, along with a witness list containing a brief summary of the anticipated testimony of each witness. Please send a copy of the exhibit and witness lists to me at this time.
•September 9, 2010: Hearing, commencing at 9:30 a.m. at OAH.
