Dear Counsel:

This letter constitutes the Prehearing Order concerning matters discussed in the prehearing conference held yesterday. Mr. Kaisershot appeared for the Department of Labor and Industry (Department); Mr. Anderson appeared for Wright County and Craig Schulz.

The parties agreed that this docket concerning Wright County and docket no. 3-1900-19976-2 concerning Craig Schulz, its certified building official, present similar issues and should be consolidated. They also agreed that this case will likely be resolved on cross motions for summary disposition. We set the following deadlines:

December 15, 2008: Deadline for any motion to dismiss on behalf of Wright County and/or Craig Schulz.

December 23, 2008: Deadline for the Department to respond to any motion to dismiss.

February 6, 2009: Discovery deadline.

February 20, 2009: Deadline for cross motions for summary disposition.

March 11, 2009: Deadline for responses to summary disposition motions.
