Dear Counsel:
This letter constitutes the Second Prehearing Order concerning matters discussed in the telephone conference held today. Mr. Kaisershot appeared for the Department of Labor and Industry (Department); Mr. Johnson appeared for Shoreline Design, Inc. (Licensee).
Mr. Johnson requested that the hearing be continued pending the outcome of civil litigation in the three complaints that are the subject of this proceeding; counsel for one of the complainants (Bursch) supported this request. Mr. Kaisershot objected to continuing the hearing pending the outcome of all of those cases, but did not object to a continuance for the purpose of conducting additional discovery, provided that he would be permitted to amend the Notice and Order for Hearing to allege a violation concerning a judgment recently entered against the Licensee. We set the following deadlines:
November 3, 2008: Deadline for amending the Notice and Order for Hearing.
November 14, 2008: Telephone status conference, 1:30 p.m., to discuss the status of the pending litigation. The Administrative Law Judge will initiate the call.
November 27, 2008: Deadline for exchanging exhibits and witness lists. The witness lists shall contain a brief summary of the expected testimony of each witness.
December 4-5, 2008: Hearing, commencing at 9:30 a.m. at the Office of Administrative Hearings.
