PREHEARING ORDER AND

ORDER FOR HEARING

 

          A prehearing conference was held on April 1, 2008, at 2:30 p.m. at the Office of Administrative Hearings, 600 North Robert Street, St. Paul, Minnesota 55164-0620 among the undersigned Administrative Law Judge, Assistant Attorney General Christopher M. Kaisershot, 445 Minnesota Street, Suite 1200, St. Paul, Minnesota 55101-2130 on behalf of the Department of Labor and Industry, and Scott R. Martin, 4856 Banning Avenue, White Bear Lake, Minnesota 55110 on behalf of Heartland Home Builders, Inc.

          Based upon the prehearing conference, IT IS HEREBY ORDERED as follows:

1.             Discovery shall be completed and non-dispositive motions shall be served and filed by April 23, 2008.

2.             Official notice of judicially cognizable facts and other agency facts under Minn. Stat. § 14.60 subd. 4 shall be made by May 5, 2008.

3.             Dispositive and pre-hearing motions shall be served and filed by May 5, 2008.

4.             Replies to dispositive and pre-hearing motions shall be served and filed by May 12, 2008.

5.             The parties shall simultaneously exchange and file proposed exhibit and witness lists by May 19, 2008. Exhibits shall be pre-marked using Arabic numbers without designation of the party offering the exhibit. The Department’s exhibits shall commence with the number one, and Blue Print Homes, Inc.’s exhibit numbers shall commence where the Department’s numbers end.  The witness lists shall include a brief summary of the expected testimony of each witness.

6.             The parties shall notify the Administrative Law Judge by May 19, 2008, whether they will require the services of a court reporter at the hearing. Otherwise, the hearing will be digitally recorded.

7.             To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits.

8.             The parties shall appear at the hearing with at least three copies of each exhibit that they plan to offer into evidence.

9.             The contested case hearing shall be held on May 29, 2008 commencing at 9:30 a.m. at the Office of Administrative Hearings, 600 North Robert Street, St. Paul, Minnesota.
