In the Matter of New Tradition Homes, Inc. and Custom Living Homes, LLC

ORDER FOR

CONTINUED HEARING

 

          After commencement of the hearing on January 17, 2008, Mr. Michael Greer, owner and representative for New Tradition Homes, Inc. and Custom Living Homes, LLC (“Licensees”), presented argument on Licensees’ request for a continuance and Assistant Attorney General Christopher M. Kaisershot, counsel for the Department of Labor and Industry (“Department”) presented argument against a continuance.

          Based upon the arguments and good cause being shown that Licensees could not effectively proceed due to their legal counsel’s withdrawal immediately prior to the hearing, the undersigned Administrative Law Judge grants a continuance, and IT IS HEREBY ORDERED as follows:

1.             The contested case hearing shall continue on February 19, 2008, commencing at 9:30 a.m. at the Office of Administrative Hearings, Harold E. Stassen Office Building, 600 North Robert Street, St. Paul, Minnesota 55101.

2.             To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits.

3.             Parties and/or counsel shall simultaneously exchange and file proposed exhibit and witness lists by February 12, 2008.  The witness lists shall include a brief summary of the expected testimony of each witness.

4.             The parties shall appear at the hearing with at least three copies of each exhibit they plan to offer into evidence.  Exhibits shall be pre-marked using Arabic numbers without designation of the party offering the exhibit.  The Department’s exhibits shall commence with the number one, and Licensees’ exhibit numbers shall commence where the Department’s numbers end.


5.             Parties and/or counsel shall notify the Administrative Law Judge by February 12, 2008, whether they will require the services of a court reporter at the hearing.  Otherwise, the hearing will be digitally-recorded.
