ORDER FOR CONTINUANCE

The above-entitled matter was scheduled for hearing before Administrative Law Judge Raymond R. Krause (“ALJ”) on January 23 and 24, 2007.

Christopher M. Kaisershot, Assistant Attorney General, 445 Minnesota Street, Suite 1200, St. Paul, MN 55101, represented the Minnesota Department of Labor and Industry (“the Department”). James Peirce, the former manager of Executive Homes Minnesota, LLC, 331 2^nd Street, W. Hector, Minnesota, 55342 represented the Respondent.

On January 8, 2007 the ALJ received a Notice of Withdrawal of counsel for Respondent. On January 17, 2007, Mr. Peirce, on behalf of Respondent, requested a continuance in order to retain new counsel. Counsel for the Department agreed to a continuance in this matter.

On January 23, 2007, a prehearing conference was held by telephone. Respondent had not yet obtained new counsel and requested ten days further continuance to do so. Counsel for the Department agreed.

At the request of the Respondent, and for good cause shown,

IT IS HEREBY ORDERED:

1. This matter is continued to February 8, 2007, at 9:00 a.m. at which time a telephone prehearing conference will be held.

2. Mr. Peirce shall have new counsel for Respondent submit a Notice of Appearance with a phone number at which he or she will be able to be reached at 9:00 a.m. on February 8, 2007.

3. At the prehearing conference, a date will be set for the hearing to be rescheduled. Parties should come prepared to provide available dates for the hearing.
