This letter constitutes the Second Prehearing Order concerning matters discussed in the prehearing telephone conference held this morning. Mr. Tostengard appeared for the Department of Labor and Industry; Mr. Olson appeared for Dev-Con Builders, Inc. Based on your agreement that most of the critical facts can be reduced to a written stipulation, which you need some time to prepare, the hearing in this matter is continued from 9:30 a.m. on January 5, 2006, to 1:30 p.m. on January 24, 2006. The hearing will take place at the Office of Administrative Hearings. If you are able to agree that a hearing is not required after you have completed the written stipulation, please let me know and the hearing will be removed from the calendar.
