SCHEDULING ORDER |
This matter came before Administrative
Law Judge Manuel J. Cervantes for a Prehearing Conference on December 6, 2010,
pursuant to a Notice and Order for Hearing, filed November 1, 2010.
Rory Foley, Assistant Attorney
General, appeared by telephone on behalf the Minnesota Department of Labor and
Industry (Department). Mark S. Kittaka,
Esq., appeared by telephone on behalf of Volume Services, Inc., d/b/a
Centerplate Concessions (Respondent).
The parties have agreed to the
following contested hearing schedule.
IT IS HEREBY ORDERED:
1.
By separate
letter, the parties will request mediation services.
2.
By 4:30 p.m. on Friday, April 1, 2011, discovery shall
close.
3.
By 4:30 p.m. on Friday, April 29, 2011, each party will
file and serve copies of the pre-labeled exhibits that it proposes to offer
into the hearing record. The Department shall
label its exhibits sequentially using numbers.
Respondent shall label its exhibits sequentially using letters.
4.
By 4:30 p.m. on Friday, April 29, 2011, each party will
file and serve a list of the witnesses that it intends to call at the
evidentiary hearing, including a short summary of their witnesses’ proposed
testimony.
5.
By 4:30 p.m. on Friday, May 6, 2011, the parties will
file and serve a statement (under Minn. R. 1400.6950 (2)) detailing any
objection to the foundation of a written exhibit.
6.
A hearing in this
matter will be held at the Office of Administrative Hearings,
