Dear Mr. Evans and Mr. Asp:
This letter constitutes the Prehearing Order concerning matters discussed in the prehearing conference held on September 9, 2008. Mr. Evans appeared for the Department of Labor and Industry (Department); Mr. Asp appeared for Great Ideas Home Improvement, Inc. (Respondent), without counsel.
We set the following deadlines:
November 7, 2008: Deadline for Mr. Asp to answer the Complaint. The Answer should be mailed to Mr. Evans, with a copy sent to the Administrative Law Judge. As we discussed during the conference, Mr. Asp needs to respond to each paragraph of the Complaint by saying whether he agrees or disagrees with the substance of each paragraph.
January 2, 2009: Deadline for exchanging exhibits and witness lists. The witness lists shall contain a brief summary of the expected testimony of each witness. The parties shall provide copies of the exhibit and witness lists to the Administrative Law Judge.
January 9, 2009: Hearing, commencing at 9:30 a.m. at the Office of Administrative Hearings.
The parties anticipated, based on previous settlement discussions, that they may be able to resolve this matter without a hearing. We set the deadlines above with the expectation that the parties will engage in active settlement discussions prior to the November 7, 2008, deadline for answering the Complaint. In the event that the matter is not resolved by agreement, I enclose for Mr. Asp the materials from our website (How to Prepare for a Contested Case Hearing and How to be a Good Witness).
