Dear Counsel:
This letter constitutes the Prehearing Order concerning matters discussed in the telephone prehearing conference held on December 12, 2007. Ms. Leppink appeared for the Department of Labor and Industry (Department); Mr. Kaster appeared for Viracon, Inc. (Respondent).
We set the following deadlines:
February 13, 2008: Deadline for expert witness disclosure, in compliance with the requirements of Minn. R. Civ. P. 26.02(d).
March 12, 2008: Discovery deadline. All discovery requests shall be served sufficiently prior to this deadline to allow for timely responses by this date.
March 26, 2008: Dispositive motion deadline.
April 9, 2008: Deadline for replies to dispositive motions.
April 30, 2008: Deadline for exchanging exhibits and witness lists. The witness lists shall contain a brief summary of the expected testimony of each witness. The parties shall provide copies of the exhibit and witness lists to the Administrative Law Judge.
May 7-9, 2008: Hearing, commencing at 9:30 a.m. at the Office of Administrative Hearings.
The hearing will be digitally recorded, unless a party requests a court reporter. Given the expected length of the hearing, the parties should consider using a court reporter. Please let me know if you wish to do so, and we will make the appropriate arrangements.
Deadlines for submission of post-hearing briefs will be set at the conclusion of the hearing. In addition, if the time or place of the hearing is not convenient for the witnesses, please let me know so we can make alternative arrangements.
