PREHEARING ORDER

A prehearing conference was held by telephone on March 24, 2005. Omar A. Syed, Assistant Attorney General, 445 Minnesota Street, Suite 900, Saint Paul, MN 55101-2127, appeared on behalf of the Commissioner of Labor and Industry. Phyllis Karasov, Moore, Costello & Hart, PLLP, 55 East 5^th Street, Suite 1400, Saint Paul, MN 55101, appeared on behalf of Croell Redi-Mix. Hank Randolph was also present by telephone.

IT IS HEREBY ORDERED:

1. The parties shall continue to cooperate in the completion of discovery.

2. A telephone conference will be held on May 24, 2005 at 3:30 p.m. Counsel shall notify the administrative law judge of any change in the telephone number for contact on that day. At that time, the hearing schedule will be reviewed, and a schedule set for the exchange of written exhibits and witness lists.

3. This matter is scheduled for hearing on June 22, 2005, commencing at 9:30 a.m. at the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, MN 55401. The hearing will continue on June 23, 2005, if necessary.

4. The parties have not requested accommodation for a disability or appointment of an interpreter. The Office of Administrative Hearings shall be notified promptly if either an accommodation or interpreter is needed.

5. This case may be appropriate for mediation. The parties are encouraged to consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled promptly.
