SIXTHPREHEARING ORDER |
This matter came before Administrative Law Judge Eric L. Lipman upon the motion of John W. Richardson to quash the subpoena dated November 18, 2010.
Because of the upcoming evidentiary hearing in this matter, the undersigned issues this denial of the motion to quash without awaiting the Department’s response as permitted by Minn. R. 1400.6600.
Based upon the filing from Mr. Richardson, and for the reasons set out in the December 2, 2010 Order on PAR Inc.’s Motion to Quash,
IT IS HEREBY ORDERED:
1. Mr. Richardson’s motion to quash the subpoena issued to CRCC is DENIED.
2. Counsel for Mr. Richardson may, by 4:30 p.m. on Tuesday, December 14, 2010, file and serve proposed modifications to the Protective Order dated June 12, 2010 (as modified by the Fifth Pre-Hearing Order) as to the use, labeling and handling of CRCC-related information. The initial service of such proposals shall be made by Mr. Richardson’s counsel by facsimile.
3. Counsel for Mr. Richardson may make a presentation on any timely-filed proposals for modification at the beginning of the evidentiary hearing on Wednesday, December 15, 2010.
