ORDER
GRANTING MOTION TO COMPEL DISCOVERY |
Whereas, the Department of Labor and
Industry has moved to compel discovery;
Whereas, the undersigned has reviewed
said motion, as well as the facts and information contained in the file at the
Office of Administrative Hearings, and has determined that the response to the
Demand for Discovery is now overdue pursuant to Minn. R. 1400.6700, subp. 2 (2007);
Whereas, the documents requested by
the Department of Labor and Industry relate to work performed at the following
address (hereinafter the “Dollar Tree Store”): International Falls MN
Associates, LLC,
NOW, THEREFORE, IT IS HEREBY ORDERED
that Carl Bowman and Bowman Construction Company Inc.,
shall provide the following documents to counsel for the Department of Labor
and Industry no later than October 27, 2008:
1.
All time sheet
records of all employees or other representatives of Carl Bowman and Bowman
Construction Company, Inc., who performed any work on or after July 16, 2007,
at the Dollar Tree Store. These time sheet records shall identify the position
of each employee or other representative who performed work and shall include the
time worked by that individual.
2.
All bid
documents, specifications, contracts, correspondence, notes, photographs,
diagrams, blueprints, and invoices for work performed on or after July 16,
2007, by or on behalf of Carl Bowman or Bowman Construction Company, Inc., at
the Dollar Tree Store, in connection with the installation of any sewer, any
pipes, or any plumbing fixtures, fittings, or joining materials.
