Dear Counsel:

 

          This letter constitutes the Prehearing Order concerning matters discussed in the telephone prehearing conference held on April 10, 2007.  Ms. Matzek, along with Rory Foley, appeared for the Department of Labor and Industry (Department); Mr. Clapp appeared for John Richardson (Respondent).  The parties requested a Protective Order, which is enclosed herewith.

 

We set the following deadlines: 

 

August 10, 2007:               Deadline for expert witness disclosure, in compliance with the requirements of Minn. R. Civ. P. 26.02(d).

 

September 14, 2007:         Discovery deadline.  All discovery requests shall be served sufficiently prior to this deadline to allow for timely responses by this date.

 

September 28, 2007:         Dispositive motion deadline.

 

October 12, 2007:             Deadline for replies to dispositive motions.

 

November 2, 2007:            Deadline for exchanging exhibits and witness lists.  The witness lists shall contain a brief summary of the expected testimony of each witness.  The parties shall provide copies of the exhibit and witness lists to the Administrative Law Judge.

 

November 13-16

And 19-21, 2007:               Hearing, commencing at 9:30 a.m. at the Office of Administrative Hearings.

                                       

          Given the expected length of the hearing, the parties should consider using a court reporter.  Please let me know if you wish to do so, and we will make the appropriate arrangements.

 

          In addition, Mr. Clapp anticipates filing a motion for severance of the counts in the Complaint.  The Department shall respond to such a motion within ten business of receipt.

 

          Deadlines for submission of post-hearing briefs will be set at the conclusion of the hearing.
