In the Matter of the Consolidated Rate Appeals of EWL Enterprises, Inc. d/b/a/ Golden Oaks Nursing Home and Wedgwood Health Care Center, Inc.

ORDER OF SEVERANCE

            The above-captioned matter came on for a prehearing conference before the undersigned Administrative Law Judge on June 15, 1995.  Paul M. Landskroener, Assistant Attorney General, 900 NCL Tower, 445 Minnesota Street, St. Paul, Minnesota 55101-2127, appeared on behalf of the Minnesota Department of Human Services (Department).  Susan M. Voigt, Attorney at Law; Siegell, Brill, Greupner & Duffy, P.A.; 1300 Washington Square, 100 Washington Avenue South, Minneapolis, Minnesota 55401, appeared on behalf of EWL Enterprises, Inc., d/b/a Golden Oaks Nursing Home.  No appearance was entered by Wedgwood Health Care Center, Inc.

At the hearing, EWL Enterprises Inc., moved to severe it’s contested case from that of Wedgewood Health Care Center, Inc.  Because the rate appeals filed by EWL Enterprises, Inc. do not present substantially the same issues of fact, its Petition for Severance was granted.

NOW, THEREFORE, IT IS HEREBY ORDERED:

1.        The rate appeals of EWL Enterprises, Inc., d/b/a Golden Oaks Nursing Home are hereby severed from the rate appeals of Wedgewood Health Center, Inc.

2.        The rate appeals of EWL Enterprises, Inc. shall be docketed under the Docket No. 8-1800-9690-2.  The rate appeals of Wedgewood Health Care Center, Inc. shall be docketed under Docket No. 8-1800-9806-2.
