SECOND SCHEDULING ORDER |
This matter initially came before Administrative
Law Judge Manuel J. Cervantes pursuant to a Notice of and Order for Hearing, filed
December 3, 2010.
Kathleen Heaney, Assistant Sherburne
County Attorney, represents Sherburne County Social Services and the Minnesota
Department of Human Services (Department). Jessica E. Schwie, Esq., represents Nicholle
Leigh Bode (Respondent).
On December 20, 2010, Ms. Schwie filed a Notice of
Motion and Motion for a Continuance on the grounds that 1) she was recently
hired to represent the Respondent and requires additional time to prepare for
the contested case hearing and 2) Respondent’s daycare license has been
suspended and she is not currently providing such care, and therefore, does not
pose any risk to recipients of daycare services.
Good cause is shown, therefore,
IT
IS HEREBY ORDERED:
1.
By 4:30 p.m. on Friday, February 18, 2011, each party
will file and serve copies of the pre-labeled exhibits that it proposes to
offer into the hearing record. The Department
shall label its exhibits sequentially using numbers. The Respondent shall label her exhibits
sequentially using letters.
2.
By 4:30 p.m. on Friday, February 18, 2011, each party
will file and serve a list of the witnesses that it intends to call at the
evidentiary hearing, including a short summary of their proposed testimony.[1]
3.
By 4:30 p.m. on Friday, February 25, 2011, the parties
will file and serve a statement (under Minn. R. 1400.6950 (2)) detailing any
objection to the foundation of a written exhibit.
4.
A hearing in this
matter will be held at the Spruce Room,
