Dear Counsel:

 

          This letter constitutes the First Prehearing Order in the above matter regarding matters discussed in the telephone conference call held this morning.  Ms. Oberg appeared for the Department of Human Services; Mr. Roby appeared for Marlys and Harold Ostlund, who also participated in the conference call.  During the conference, the parties agreed that the two matters present common issues of fact and law and should be consolidated.  We set the following schedule:

 

          February 11, 2011:            Deadline for the parties to exchange all exhibits they intend to offer into evidence at the hearing, along with a witness list that contains a brief summary of the anticipated testimony of each witness.

 

          February 22, 2011:            Hearing, commencing at 10:00 a.m. at the Office of Administrative Hearings, St. Paul, Minnesota.
