Dear Ms. Hawkinson and Ms. Holweger:
This letter constitutes the First Prehearing Order regarding matters discussed in the telephone prehearing conference held on October 6, 2010. Ms. Hawkinson appeared for the Department of Human Services; Ms. Holweger appeared for herself without counsel. The issue in this case is whether the Department properly suspended Ms. Holweger’s participation in the Minnesota Health Care Program based on its determination that she submitted claims for reimbursement for services she did not provide.
We set the following schedule:
November 5, 2010: Deadline for Ms. Holweger to request a change of location for the hearing based on the convenience of witnesses.
November 23, 2010: Deadline for the parties to exchange all exhibits they intend to offer into evidence at the hearing, along with a witness list containing a brief summary of the anticipated testimony of each witness. Please forward a copy of the exhibit and witness lists to me at this time.
December 3, 2010: Hearing, commencing at 9:30 a.m., tentatively set at the Office of Administrative Hearings unless a change in location is required for the convenience of witnesses.
The parties agreed that they will make discovery requests in writing in order to obtain copies of documents supporting their positions on the disputed issues.
