SCHEDULING ORDER

This matter came before Administrative Law Judge Manuel J. Cervantes for a Scheduling Conference on November 9, 2009. Barry R. Greller, Assistant Attorney General, appeared telephonically on behalf of the Department of Human Services (Department). Samuel R. Orbovich and Katherine A. Burkhart, Esqs., appeared telephonically on behalf of Olmsted Medical Center (Provider). The parties agreed to the schedule set forth below.

IT IS HEREBY ORDERED:

1. By 4:30 p.m. on Friday, January 8, 2010, discovery will close.

2. By 4:30 p.m. on Friday, January 22, 2010, the parties will file a joint stipulation of facts.

3. By 4:30 p.m. on Monday, February 22, 2010, the Department will file and serve its motion for summary disposition.

4. By 4:30 p.m. on Monday, March 22, 2010, the Provider will file and serve its responsive pleadings.

5. By 4:30 p.m. on Monday, March 29, 2010, the Department will file and serve its reply.

6. By 4:30 p.m. on Monday, April 5, 2010, the Provider will file and serve its reply.

7. Oral argument in this matter will be held at the St. Paul office of the Office of Administrative Hearings, 600 Robert Street North, on Tuesday, April 13, 2010, commencing at 9:30 a.m., courtroom to be assigned upon arrival at the first floor reception desk.
