SECOND PREHEARING ORDER

A prehearing conference was held by telephone on September 29, 2009. Corrie A. Oberg, Assistant Attorney General, appeared on behalf of the Department of Human Services (Department). Jack E. Pierce, Attorney at Law, appeared on behalf of Metro Therapy Special Children’s Clinic, Inc. (Respondent).

The parties have completed discovery and have agreed to discuss settlement.

IT IS HEREBY ORDERED:

1. The Department of Human Services shall file a Motion for Summary Disposition by November 9, 2009, or notify the undersigned and counsel for the Respondent by November 2, 2009, that it does not intend to do so.

2. If a Motion for Summary Disposition is filed, the Respondent shall file its response by November 30, 2009, and the Department shall file its reply, if any, by December 7, 2009.

3. If no Motion for Summary Disposition is filed, the undersigned will schedule a telephone conference to set the date for hearing.

4. This case may be appropriate for mediation. The parties are encouraged to consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled promptly.
