In the Matter of the SIRS Appeal of Metro Therapy Special Children’s Clinic, Inc.

PREHEARING ORDER

A prehearing conference was held by telephone on July 8, 2009. Corrie A. Oberg, Assistant Attorney General, appeared on behalf of the Department of Human Services. Jack E. Pierce, Attorney at Law, appeared on behalf of Metro Therapy Special Children’s Clinic, Inc.

The parties have agreed that some limited discovery is needed in this matter, and that a protective order may be required to protect the names of patients. Ms. Oberg will draft a proposed order and provide the draft to Mr. Pierce for comment. Since it is uncertain at this time whether the matter can be resolved on summary disposition or an evidentiary hearing will be required, another prehearing conference will be scheduled.

IT IS HEREBY ORDERED:

1. Discovery shall be completed by October 1, 2009.

2. A telephone prehearing conference will be held on September 29, 2009, commencing at 1:30 p.m., to either set a briefing schedule for summary disposition or schedule the matter for hearing.

3. This case may be appropriate for mediation. The parties are encouraged to consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled promptly.
