Dear Counsel:

This letter constitutes the Prehearing Order concerning matters discussed in the telephone prehearing conference on July 28, 2008. Mr. Zuleger appeared for the Department of Human Services and Washington County; Mr. Bowen appeared for Susan Orth (Licensee), who also participated in the conference. Based on the Licensee’s recent plea of guilty to a theft charge, the parties agreed that the hearing will focus on the issue whether the disqualification should be set aside. The hearing will take place commencing at 2:30 p.m. on September 19, 2008. Mr. Zuleger will reserve a room in Washington County and advise us of the location. The parties should exchange all exhibits they plan to offer into evidence, along with a witness list containing a brief summary of the anticipated testimony of each witness, by September 9, 2008.
