Re:     In the Matter of the Maltreatment Determination and Disqualification of Terri Jackson and the Revocation of the Child Foster Care License of Barbara Jackson and Terri Jackson

OAH Docket No. 3-1800-19651-2

Dear Counsel:

This letter constitutes the First Prehearing Order concerning matters discussed in the prehearing telephone conference on May 30, 2008.  Mr. Schneider appeared for the Department of Human Services (Department); Mr. Lynch appeared for Hennepin County Child Protection Services (County); and Ms. Groshek appeared for Barbara Jackson and Terri Jackson (Licensees).  According to the Notice and Order for Hearing, Ms. Groshek is representing both Licensees, and I would appreciate it if she would file a Notice of Appearance either confirming that is true or clarifying which of the Licensees she represents.  During the conference we set the following schedule:

July 28, 2008:         Deadline for the parties to exchange all exhibits they                                                      intend to offer into evidence at the hearing, along with                                            a witness list containing a brief summary of the                                                   anticipated testimony of each witness.  The parties                                                             shall provide to the Administrative Law Judge copies                                                             of the exhibit and witness lists, but not the exhibits.

August 5-6, 2008:    Hearing, commencing at 9:30 a.m. at the Office of                                                         Administrative Hearings.

The hearing will be digitally recorded unless someone requests a court reporter and agrees to pay for it.  I have also enclosed the Protective Order we discussed during the prehearing conference.

                                                            Sincerely,

                                                                      s/Kathleen D. Sheehy
