Dear Counsel:
This letter constitutes the First Prehearing Order concerning matters discussed in the prehearing telephone conference on September 26, 2007. Ms. Hawkinson appeared for the Department of Human Services; Mr. Johnson appeared for West Metro Recovery Services (Respondent). During the conference we set the following schedule:
December 15, 2007: Deposition deadline. All depositions must be noticed sufficiently in advance of the deadline so that they can be completed by this date.
January 15, 2008: Deadline for completion of written discovery. All written discovery must be requested sufficiently in advance of the deadline so that it can be responded to by this date.
January 31, 2008: Deadline for the parties to exchange all exhibits they intend to offer into evidence at the hearing, along with a witness list containing a brief summary of the anticipated testimony of each witness. The parties shall provide to the Administrative Law Judge copies of the exhibit and witness lists, but not the exhibits.
February 11-15, 2008: Hearing, commencing at 9:30 p.m. at the Office of Administrative Hearings.
If the Department wishes to have a court reporter transcribe the hearing, please let me know by mid-January 2008 so that we can make the appropriate arrangements. Otherwise, we will use our digital recording system.
