In The Matter of the Maltreatment Determination and Order to Forfeit a Fine for Metro Work Center, Inc.

 

SECOND PREHEARING ORDER

 

          A prehearing conference was held in the above-captioned matter at the Office of Administrative Hearings in Minneapolis, Minnesota, on December 22, 2005, at 1:30 p.m.  Gail A. Feichtinger, Assistant Attorney General, Suite 900, 445 Minnesota Street, St. Paul, MN  55101-2137, appeared on behalf of the Department of Human Services.  M. Kevin Snell, Attorney at Law, 110 Mill Place, 111 Third Avenue South, Minneapolis, MN  55401, appeared on behalf of the Respondent, Metro Work Center, Inc. 

By letter dated March 22, 2006, Mr. Snell informed the Administrative Law Judge that the parties have agreed to continue the hearing dates in this matter.  Based upon this agreement, IT IS HEREBY ORDERED that the following modifications be made in the First Prehearing Order issued on December 22, 2005:

1.     Counsel shall exchange and file proposed exhibit and witness lists by May 2, 2006.  The witness lists shall include a brief summary of the expected testimony of each witness. 

2.     To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits.

3.     Counsel shall notify the Administrative Law Judge by May 9, 2006, whether they will require the services of a court reporter at the hearing.  Otherwise, the hearing will be tape-recorded.

4.     The hearing in this matter shall be held on May 16-17, 2006, commencing at 9:30 a.m. each day in the courtrooms of the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, Minnesota. 

5.     The parties shall appear at the hearing with at least three copies of each exhibit they plan to offer into evidence.  Exhibits shall be pre-marked using Arabic numbers without designation of the party offering the exhibit.
