ORDER FOR CONTINUANCE

 

          The above-entitled matter was scheduled for hearing before Administrative Law Judge Beverly Jones Heydinger (“ALJ”) on January 19, 2005.   

Appearances:  Rebecca S. Morrisette, Assistant Hennepin County Attorney, 525 Portland Avenue, Suite 1210, Minneapolis, MN 55415-0972, for the Department of Human Service (“Department”).  William and Marilyn Kilgore, 3443 Logan Avenue North, Minneapolis, MN 55412-2331, on their own behalf.

The parties have entered into negotiations to resolve this matter, but a final agreement has not been reached.  At the request of the Department, and for good cause shown,

IT IS HEREBY ORDERED:

1.       The hearing in this matter is continued to March 23, 2005, at 9:30 a.m. at the Office of Administrative Hearings.

2.       The parties are urged to exchange with each other and file with the Administrative Law Judge a copy of their exhibit lists and witness lists, or amendments to the lists previously filed, by March 16, 2005.

3.       Failure to appear at the hearing without the prior approval of the judge may result in the allegations or issues set out in the Notice and Order for Hearing being taken as true.  See Minn. R. 1400.6000.
