In the Matter of the Rate Appeal of REM Minnesota, Inc.

PREHEARING ORDER

            A status conference was held by telephone on June 3, 2005. Barry Greller, Assistant Attorney General, 445 Minnesota Street, Suite 900, St. Paul, MN 55101, appeared on behalf of the Department of Human Services (“Department”).  Gregory Merz, Gray, Plant, Mooty, Mooty & Bennett, P.A., 500 IDS Center, 80 South Eighth Street, Minneapolis, MN 55402, appeared on behalf of REM Minnesota, Inc. (“Respondent”).

            The parties agreed that discovery has been completed.  The Department intends to bring a motion for summary disposition.  The parties agreed to a schedule for filing the motion and response.

IT IS HEREBY ORDERED:

1.                    The Department shall serve and file any dispositive motions by August 1, 2005 and the Respondent shall serve and file a response by August 15, 2005.  If the Department intends to reply, it must file the reply by August 22, 2005.

2.                    This matter is not scheduled for hearing at this time.  In the event that the Department’s motion and the response to it do not resolve all the issues, a prehearing conference will be held to set the schedule for hearing. 

3.                    This case may be appropriate for mediation.  The parties are encouraged to consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled promptly.
