This letter constitutes the Ninth Prehearing Order concerning matters discussed in the telephone conference on May 3, 2006. Ms. Sullivan appeared on behalf of the Department of Human Services; Mr. Flynn appeared on behalf of Geritom Medical. The procedural schedule is revised as follows in accordance with your agreement:
·July 14, 2006: Discovery deadline.
·July 21, 2006: Deadline for expert witness disclosure.
·August 4, 2006: Deadline for any follow-up expert discovery.
·August 16, 2006: Deadline for filing any dispositive motions.
·August 30, 2006: Deadline for responding to any dispositive motions.
·September 6, 2006: Deadline for a reply to any response.
·September 20, 2006: Deadline for exchange of witness lists, exhibit lists, and copies of all exhibits to be offered at the hearing, as provided in the First Prehearing Order.
·October 4-5, 2006: Hearing, commencing at 9:30 a.m. at the Office of Administrative Hearings.
The deadlines for submission of post-hearing briefs and proposed findings will be set at the conclusion of the hearing.
