ORDER

 

 

 

            This matter was begun by the Minnesota Department of Human Services by issuing a Notice of and Order for Hearing on November 19, 1997.  That Notice, which was served upon the Respondents Joe and Delores Arrington, scheduled the hearing in this matter before the undersigned Administrative Law Judge at 9:30 a.m. on Thursday, February 26, 1998.  The hearing was subsequently continued indefinitely to allow the Respondents time in which to hire counsel to represent them.  They engaged Kyle D. White, Attorney at Law, to represent them, and Mr. White requested the Administrative Law Judge to schedule a prehearing conference in order to discuss discovery and narrow the issues.  That prehearing conference was set for 2:00 p.m. on Wednesday, April 15, 1998.

 

            On April 14, 1998, Mr. White gave written notice that he had withdrawn as counsel of record for the Respondents in this proceeding.  The prehearing conference was held beginning at 2:00 p.m. on Wednesday, April 15, 1998.  Duane A. Bartz, Assistant Hennepin County Attorney appeared as attorney for the Hennepin County Department of Children and Family Services and the Minnesota Department of Human Services.  The Respondents did not appear at the prehearing conference, nor did anyone else appear on their behalf.


 

            In view of the foregoing,

 

            IT IS HEREBY ORDERED:

 

            1.         That the parties appear at 9:30 a.m. on Wednesday, May 27, 1998, at the Office of Administrative Hearings, 100 Washington Square Building (Washington Avenue South), Suite 1700, Minneapolis, Minnesota, for the hearing in the above-entitled matter.

 

            2.         The Respondents are advised that pursuant to Minnesota Rules pt. 1400.6000 (1997), their failure to appear at that Hearing shall constitute a default, permitting the undersigned Administrative Law Judge to take the allegations and the issues set out in the Notice of and Order for Hearing as true and deemed proved without further evidence.
