In the Matter of the SIRS Appeal of
Sincerely, Inc. ORDER
The Commissioner of Human Services originally began this matter by issuing a Notice of and Order for Hearing and Pre-Hearing Conference on May 4, 1998. On August 19, 1998, the Administrative Law Judge issued a report to the Commissioner recommending that Ace Care’s appeal be dismissed because it had defaulted by failing to appear for a scheduled prehearing conference without first offering an excuse to and seeking a continuance from the Administrative Law Judge.
The Commissioner subsequently found that Ace Care’s failure to appear was excusable and by Order issued on December 9, 1998, remanded this matter back to the Administrative Law Judge for further proceedings on the merits of Ace Care’s claim.
Because of these developments,
The Administrative Law Judge hereby ORDERS that the parties appear at 9:30 a.m. on Wednesday, February 17, 1999, at the Office of Administrative Hearings, 100 Washington Square Building (Washington Avenue South), Suite 1700, Minneapolis, Minnesota, for a prehearing conference in this contested case proceeding.
