ORDER ESTABLISHING PROCEDURE AFTER REMAND |
TO: The Minnesota Department of Human Rights and its attorneys, Carl Warren, Attorney at Law, and Heather Elliot, Student Attorney, Civil Practice Clinic, University of Minnesota, 190 Law Center, 229 - 19th Avenue South, Minneapolis, Minnesota 55455; and the City of Minneapolis and its attorneys, C. Lynne Fundingsland and Deborah A. Styles, Assistant City Attorneys, 300 Metropolitan Centre, 333 South Seventh Street, Minneapolis, Minnesota 55402-2453.
WHEREAS, the Administrative Law Judge has been informed that the Minnesota Supreme Court has denied review of the Court of Appeals’ decision which remanded the entitled matter to the Office of Administrative Hearings;
WHEREAS, the record has not been returned to the Office of Administrative Hearings, however, the Administrative Law Judge believes that it is appropriate to initiate a process to address the remanded issues;
WHEREAS, it is appropriate to require that the parties identify the issues that remain for resolution after the remand and it is also appropriate to encourage the parties to jointly consider a proposed resolution of those remanded issues;
NOW, THEREFORE, it is reasonable and appropriate to issue the following:
ORDER
IT IS HEREBY ORDERED:
1. The parties shall identify and file a list of issues that remain for resolution after remand of this case by the Court of Appeals. The parties shall file their lists with the Office of Administrative Hearings by January 20, 1999.
2. The parties shall serve their list of issues upon each other by January 20, 1999. Upon receipt of the issue list, the parties are encouraged to enter discussions to identify mutually acceptable resolutions.
3. By February 20, 1999, the parties shall file with the Office of Administrative Hearings a list of issues identifying (a) which issues can be resolved and (b) which issues continue to be contested.
4. All issues identified by the parties shall be carefully cross-referenced to the Orders issued in this case.
