PREHEARING ORDER

          A prehearing conference was held on February 5, 2008, at the Office of Administrative Hearings, 600 North Robert Street, St. Paul, MN.  Margaret Jacot, Assistant Attorney General, 445 Minnesota Street, Suite 900, St. Paul, MN 55101-2127, appeared on behalf of the Department of Human Rights.  Andrew D. Parker, Parker Rosen LLC, 300 First Avenue North, Suite 200, Minneapolis, MN 55401, appeared on behalf of Unbank Company, LLP.

 

IT IS HEREBY ORDERED:

1.               The Department has refused to turn over its file to the Respondent because it contends that doing so will disclose the Department’s investigative process.  It has agreed to submit the file to the Administrative Law Judge for in camera review and determination whether the file or portions of it should be disclosed, and if so, whether it is necessary to issue a Protective Order.  The Department shall notify the Complainant that the file will be submitted for review.

2.               Discovery shall be completed by June 16, 2008.

3.               Any dispositive motions shall be served by July 9, 2008, and the responding party shall have until August 11, 2008, to respond.  Any reply must be filed by August 25, 2008.  Following a ruling on the dispositive motion, if there are claims remaining, a prehearing conference will be convened by telephone to schedule the matter for hearing.

4.               The parties have agreed that copies of the Orders issued in this matter may be sent to counsel for the Complainant, Tammy Friederichs, Friederichs & Thompson, P.A., 1120 East 80th Street, Suite 106, Bloomington, MN 55401.


5.               This case may be appropriate for mediation.  The parties are encouraged to consider requesting the Chief Administrative Law Judge to assign a mediator so that mediation can be scheduled promptly.
