MEDIATION ORDER

 

WHEREAS, all parties to the above matter have consented to mediate the above matter,

THEREFORE, IT IS HEREBY ORDERED, pursuant to Minnesota Rules, part 1400.5950 that George A. Beck, Administrative Law Judge, Suite 1700, 100 Washington Square, Minneapolis, Minnesota 55401, telephone 612/341-7601, is appointed as mediator in this matter, and that the mediation shall be held on October 31, 2001, beginning at 9:00 a.m., at Xcel Energy-Northern States Power Company, 414 Nicollet Mall, Minneapolis, Minnesota.

IT IS FURTHER ORDERED that, no later than one week prior to the mediation, each party shall file with the mediator a confidential mediation statement which shall set out (1)  a brief summary of the facts and issues, and (2) a list of the names and titles of person(s) who will attend the mediation.  The mediation statement need not be served on the other party.  The person with authority to settle this case for each party must be present.

IT IS FURTHER ORDERED that after termination of the mediation the mediator shall forward to the agency a signed settlement agreement or, if no agreement is reached, the mediator shall inform the agency that the mediation has been terminated without agreement.
