DISMISSAL ORDER |
The above-entitled matter is pending before the undersigned Administrative Law Judge pursuant to a Notice of and Order for Hearing dated November 20. 1997.
Sonja Dunnwald Peterson, Attorney at Law, 400 Flour Exchange Building, 310 Fourth Avenue South, Minneapolis, MN 55415, appeared on behalf of the Complainant. Timothy D. Webb, Assistant Attorney General, 1100 NCL Tower, 445 Minnesota Street, St. Paul, MN 55101-2128, appeared on behalf of Respondent.
On December 17, 1999 a Stipulation of Dismissal signed by counsel for both parties was filed with the Office of Administrative Hearings. In their Stipulation, the parties agreed that the above-captioned matter should be dismissed with prejudice, without any admission of liability on the part of Respondent, and without any award of costs, or attorneys fees which are not already provided for in the Settlement Agreement and Release of all Claims, and without further notice to the parties and their respective counsel. In view of the parties’ agreement, this matter should be dismissed.
NOW, THEREFORE, pursuant to Minn. Stat. §§ 14.59 and 363.071 and Minn. Rules, pts. 1400.5500J and 1400.5900.
IT IS HEREBY ORDERED: That the above-entitled matter be and hereby is DISMISSED WITH PREJUDICE without any award of costs, disbursements or attorneys fees, pursuant to the terms of the parties’ Stipulation of Dismissal.
