DISMISSAL ORDER

            The above-entitled matter is pending before the undersigned Administrative Law Judge pursuant to a Notice of and Order for Hearing dated November 18, 1996.

Andrea Mitau Kircher, Assistant Attorney General, 1200 NCL Tower, 445 Minnesota Street, St. Paul, Minnesota 55101-2130, appeared on behalf of the Complainant.  Louise Dovre Bjorkman, Attorney at Law, 2000 Metropolitan Center, 333 South Seventh Street, Minneapolis, Minnesota  55402, appeared on behalf of the Respondent.

On March 25, 1997, a Settlement Agreement signed by both of the parties to this proceeding and by the charging party was filed with the Office of Administrative Hearings.  In their Settlement Agreement, the parties agreed that the above-entitled matter should be dismissed with prejudice and without any award of costs, disbursements, or attorneys fees to either party.  In view of the parties’ agreement, this matter should be dismissed.

NOW, THEREFORE, pursuant to Minn. Stat. §§ 14.59 and 363.071 and Minn. Rules, pts. 1400.5500J and 1400.5900.

IT IS HEREBY ORDERED: That the above-entitled matter be and hereby is DISMISSED WITH PREJUDICE without any award of costs, disbursements or attorneys fees, pursuant to the terms of the parties’ Settlement Agreement.
