In the Matter of the Denial of the Licensure Application of Christopher L. Camacho.

RECOMMENDATION FOR DISMISSAL WITH PREJUDICE PURSUANT TO STIPULATION |
WHEREAS, the above matter is pending before the undersigned Administrative Law Judge pursuant to a Notice of and Order for Hearing issued by the Disciplinary Committee of the Minnesota Board of Teaching dated January 5, 4004;
WHEREAS, the parties appeared for a prehearing conference in this matter on February 12, 2004;
WHEREAS, the parties reached agreement on the terms of a settlement of this matter and placed those terms on the record during the prehearing conference as follows: (1) Christopher Comacho agreed to withdraw his request for hearing as of February 12, 2004; (2) Mr. Comacho will reapply for a teaching license in August 2004, and his application will disclose the conviction for disorderly conduct in August 2002; and (3) the Board will grant him a teaching license so that he may be licensed to teach during the 2004-05 school year, and the Board will not deny him a license based on the disorderly conduct conviction or the conduct leading to it, so long as Mr. Comacho has not been arrested for or convicted of any other charges through the time of his application. The Board encouraged Mr. Comacho to submit with his application a letter from his probation officer stating that he has been discharged from probation and that the probation officer is not aware of any subsequent arrests or convictions;
NOW, THEREFORE, IT IS RESPECTFULLY RECOMMENDED that this matter be DISMISSED WITH PREJUDICE based upon the parties’ agreement to settle made at the prehearing conference. This file shall be closed and the official record shall be returned to the Board of Teaching for final decision.
