Dear Ms. Djurovich:

 

This is to inform you that the above-referenced rules, as published in the State Register on October 25, 2010 and modified on November 8, 2010, are approved as to legality.  The Administrative Law Judge has determined there are no negative findings in these rules.

 

          As required by Minn. Stat. § 14.127, the agency has made its determination regarding the effect of the rules on small businesses and/or small cities.  The Administrative Law Judge reviewed the agency’s determination and concurs with the agency’s finding that complying with the proposed rules in the first year after the rules take effect will not exceed $25,000 for any one small business or any one small city.  The agency has also made its determination required by Minn. Stat. § 14.128 that no local government entity will be required to adopt or amend an ordinance or other regulation in order to comply with this rule change.  The Administrative Law Judge has reviewed and approves of this determination.

 

 

 

 

 

With the approval of the adoption of these rules, our Office has closed this file and is returning the rule record to you so that your agency can maintain the official rulemaking record in this matter as required by Minn. Stat. § 14.365.  Our Office will file four copies of the adopted rules with the Secretary of State, who will forward one copy to the Revisor of Statutes, one copy to the Governor, and one to the Department for its rulemaking record.  You will then receive from the Revisor’s Office three copies of the Notice of Adoption of the rules.

 

Your next step is to arrange for publication of the Notice of Adoption in the State Register.  A permanent rule without a hearing does not become effective until five working days after a Notice of Adoption is published in the State Register in accordance with Minn. Stat. § 14.27.
