The hearing in this matter is currently scheduled to begin at 9:00 a.m. on March 18, 2008, at the Office of Administrative Hearings, Room 403, 600 North Robert Street, Paul, Minnesota. On March 14, 2008, Assistant State Public Defender Sara J. Euteneuer filed a motion for leave to withdraw this appeal on the ground that Mr. McGarrity has failed to take reasonable steps to prosecute the appeal.

NOW, THEREFORE, IT IS HEREBY ORDERED:

(1) That the appeal of Eric McGarrity is hereby DISMISSED for failure to prosecute; and

(2) That the hearing in this matter, currently scheduled for 9:00 a.m. on March 18, 2008, is hereby CANCELED.
