ORDER FOR DISMISSAL

 

Gail Feichtinger, Assistant Attorney General, 445 Minnesota Street, Suite 1800, St. Paul, MN 55101-2134, represents the End of Confinement Review Committee, Department of Corrections.  F. Richard Gallo, Jr., Assistant State Public Defender, 2221 University Avenue Southeast, Suite 425, Minneapolis, MN 55414, represents Glenn Hazelton, the Petitioner.

An Order for Hearing was issued on January 29, 2004.  That Order set forth the prior continuances of this matter and notified the parties that, if the Petitioner did not appear for hearing on February 11, 2004, the matter would be dismissed.

By letter dated February 10, 2004, the Petitioner’s counsel notified the Administrative Law Judge that he had made no contact with his client.  On behalf of his client, counsel requested that the Petitioner’s Request for Administrative Review of the End of Confinement Review Committee’s determination to classify him at Risk Level II be withdrawn.

IT IS HEREBY ORDERED:

This proceeding is DISMISSED with prejudice.
