Determination of Sean Patrick Brinkman

The above matter came on for hearing on October 8, 2001 at 10:30 a.m. at the Minnesota Correctional Facility at Moose Lake.

Sean Brinkman, Minnesota Correctional Facility at Moose Lake, 1000 Lakeshore Drive, Moose Lake, MN 55767, appeared representing himself. Angela Helseth, Assistant Attorney General, 525 Park Street, Suite 500, St. Paul, MN 55703-2122, appeared representing the End of Confinement Review Committee (ECRC).

Shortly after the commencement of the hearing on October 8, 2001, Mr. Brinkman, who has the burden of proof in this proceeding under Minn. Stat. §244.052, subd. 6(b), stated on the record that he wishes to withdraw his appeal.

Therefore, based upon the record in this matter,

IT IS HEREBY ORDERED that this matter is dismissed with prejudice.
