In the Matter of the Risk Level Determination of Anthony Allen Cress

ORDER

 

 

 

            The above-entitled matter came on for hearing before Administrative Law Judge Bruce H. Johnson at 9:30 a.m. on Friday, July 11, 1997, at the Office of Administrative Hearings, 100 Washington Square – Suite 1700, Minneapolis, Minnesota.  The hearing concluded on July 11, 1997, and the record closed on August 28, 1997, upon receipt of the post-hearing briefs.

 

            F. Richard Gallo, Assistant State Public Defender, 2829 University Avenue Southeast, Suite 600, Minneapolis, Minnesota  55414, appeared on behalf of Anthony Allen Cress (hereinafter “Mr. Cress”).  Paschal Nwokocha, Assistant Attorney General, 445 Minnesota Street, Suite 900, St. Paul, Minnesota 55101-2127, appeared on behalf of the End-of-Confinement Review Committee (hereinafter “Review Committee” or “Committee”) convened at the Minnesota Correctional Facility, Faribault, Minnesota on April 7, 1997.

 

            After the hearing was completed and the record closed, the parties entered into a Stipulation under which they agreed that Mr. Cress is not a sex offender required to register and that the Minnesota Community Notification Act does not apply to him.  In view of that stipulation, the parties agreed that the Administrative Law Judge may enter an Order dismissing this proceeding.

 

 

ORDER

 

            NOW, THEREFORE, in view of the foregoing, it is hereby ORDERED that this proceeding is DISMISSED.
