SCHEDULING ORDER |
This matter came on before Administrative Law Judge Manuel
J. Cervantes pursuant to a Notice for Hearing and Order to Show Cause, filed April
7, 2010.
Michael J. Tostengard, Assistant Attorney General, represents
the Department of Commerce (Department). Cynthia Strand (Respondent) appeared on her
own behalf.
By letter dated April 28, 2010, Ms. Strand requested
that a continuance of a contested hearing in order to obtain private legal
counsel. Her requested is granted
without objection.
I am enclosing some information for Ms. Strand from
the Office of Administrative Hearings website (Contested Case Hearing Preparation and How to Be a Good Witness) to help him in preparing for the
hearing. There is information in the Contested Case Hearing Preparation document
on how to contact the Volunteer Lawyers Network concerning possible legal representation.
IT IS HEREBY ORDERED:
1.
By 4:30 p.m. on Thursday, September 9, 2010, each party
will file and serve copies of the pre-labeled exhibits that it proposes to offer
into the hearing record. The Department
shall label its exhibits sequentially using numbers. Respondent shall label his exhibits
sequentially using letters.
2.
By 4:30 p.m. on Thursday, September 9, 2010, each party
will file and serve a list of witnesses that it intends to call at the
evidentiary hearing, along with a short summary of the anticipated testimony of
their witness (es).
3.
By 4:30 p.m. on Monday, September 13, 2010, the parties
will file and serve a statement (under Minn. R. 1400.6950 (2)) detailing any
objection to the foundation of a written exhibit.
