ORDER |
This matter came on for hearing on Tuesday, November 4, 2008, at 9:30
a.m., at the Office of Administrative Hearings,
However, during the hearing, the parties advised the undersigned ALJ that they had agreed to a settlement of the issues and requested that the hearing be adjourned to enable them to consummate a written settlement agreement. The ALJ therefore adjourned the hearing and requested the parties to submit an executed copy of their settlement agreement to the ALJ to establish a basis for dismissal of this proceeding.
By letter dated February 18, 2009, the Department represented to the ALJ that the parties had been unable to complete their settlement and requested that this matter be placed back on the active calendar.
IT IS, THEREFORE, ORDERED,
(1) That the hearing in this matter shall RESUME at 9:30 a.m. on Tuesday, April 28, 2009, at the same location; and
(2) That pursuant to Minn. R. 1400.6000, failure by the Respondents to appear at the hearing shall be deemed a default, upon which the allegations of or the issues set out in the notice of and order for hearing shall be taken as true or deemed proved without further evidence.
