FIRST PREHEARING ORDER
|
A prehearing conference was held in the above-captioned matter in Courtroom 3 of the Office of Administrative Hearings on December 7, 2004, at 1:30 p.m. Christopher M. Kaisershot, Assistant Attorney General, 445 Minnesota Street, Suite 1200, St. Paul, MN 55101-2130, appeared on behalf of the Department of Commerce. Ishmael Israel, 7030 Brooklyn Blvd, Brooklyn Center, Minnesota 55429, appeared on his own behalf.
Based upon discussions with the parties during the prehearing conference, IT IS HEREBY ORDERED as follows:
1. The parties shall exchange proposed exhibit and witness lists by January 19, 2005, and file a copy of the lists with the Administrative Law Judge. The witness lists shall include a brief summary of the expected testimony of each witness.
2. To the extent possible, the parties shall enter into prehearing stipulations regarding the facts involved in the hearing and foundation for anticipated exhibits.
3. All dispositive or nondispositive motions shall be filed by January 26, 2005.
4. A prehearing conference shall be held by telephone conference call at 2:30 p.m. on February 2, 2005, to discuss the status of the case. The Administrative Law Judge will initiate the conference call.
5. The hearing will commence at 9:30 a.m. on February 23, 2005, in the courtrooms of the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, Minnesota. The hearing shall continue on February 24, 2005, if necessary.
6. The parties shall appear at the hearing with at least three copies of each exhibit they plan to offer into evidence.
