Dear Counsel:
This letter will confirm the discussions of the parties during the June 26, 2003, prehearing conference held at the Office of Administrative Hearings before Administrative Law Judge Richard Luis and constitutes the First Prehearing Order in this matter.
The parties explained during the prehearing conference that they anticipate that they will engage in settlement discussions in an attempt to resolve their dispute without the necessity of a hearing. If those discussions are unsuccessful and a hearing is necessary, it will be held on Thursday, August 28, 2003, commencing at 9:30 a.m. in the courtrooms of the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, Minnesota. The parties should appear at the hearing with at least three copies of documents that are intended to be offered into evidence. They also should make arrangements to ensure that all witnesses whom they intend to have testify are present.
