NOTICE AND ORDER FOR HEARING |
On September 16, 2004, the United States District Court, Judge Richard H. Kyle, issued a Memorandum Opinion and Order dismissing Willis v. Centennial Mortgage & Funding, Inc., et al.
NOW, THEREFORE, IT IS ORDERED:
1. The Order Staying Proceedings, issued July 16, 2003 is VACATED.
2. The hearing in this matter is reset for January 27, 2005 at 9:30 a.m. at the Office of Administrative Hearings, 100 Washington Avenue South, Suite 1700, Minneapolis, MN 55401.
3. Any additions to or modifications to the proposed exhibits or list of witnesses shall be exchanged by the parties and filed with the Office of Administrative Hearings by January 20, 2005.
4. If Respondent fails to appear at the hearing, Respondent shall be deemed in default and the allegations set forth in the Notice of and Order for Hearing dated December 3, 2002 may be deemed proved without further evidence. Minn. R. 1400.6000.
5. Any request for continuance shall be granted only upon a showing of good cause or by agreement of the parties. See Minn. R. 1400.7500.
