PREHEARING ORDER

          A prehearing was held on September 7, 2000, at 3:00 p.m. at the Office of Administrative Hearings.  Patrick M. Driscoll, Assistant Attorney General, 445 Minnesota Street, Suite 1200, St. Paul, MN  55101, appeared on behalf of the Department of Commerce.  Paul J. Lisowski, appeared by telephone on his own behalf.

          IT IS HEREBY ORDERED:

1.     Discovery shall be completed by November 10, 2000.  Unless otherwise agreed by the parties, Respondent Paul J. Lisowski shall appear for his deposition at 9:30 a.m., October 2, 2000, at Mr. Driscoll’s office, Suite 1200 NCL Tower, 445 Minnesota Street, St. Paul, MN.

2.     The deadline for filing dispositive or non-dispositive motions is December 8, 2000.  Any response to the motion must be filed within ten working days after the motion is received.

3.     This case may be appropriate for settlement.  The parties are encouraged to promptly consider settlement, and if they fail to reach one, they are encouraged to request assignment of a mediator so that mediation can be scheduled prior to the deadline for filing motions.

4.     In the event that the case is not settled or can not be resolved based upon the motions filed, a second prehearing conference will be scheduled, and conducted by telephone, in order to set a date for hearing.
