ORDER FOR CONTINUED HEARING

This matter is pending before Administrative Law Judge M. Kevin Snell pursuant to a Notice and Order for Hearing and Order for Summary Suspension from the Minnesota Department of Commerce (“Department”). The hearing commenced on May 11, 2010, and recessed on that day. The hearing record remains open because of newly discovered evidence that the Department believes is relevant and material to the issues in this matter.

The parties have had telephone status conferences on May 19, 2010, and June 9, 2010, regarding the issues relating to certain evidence and additional testimony. The parties have agreed to reconvene the hearing on June 24, 2010. Therefore, IT IS HEREBY ORDERED:

1. The contested case hearing shall reconvene on June 24, 2010, commencing at 10:00 a.m. at the Office of Administrative Hearings, 600 North Robert Street, St. Paul, Minnesota.

2. The Department shall file and serve additional exhibits it proposes to introduce by June 18, 2010, and shall appear at the hearing with at least three copies of each exhibit it plans to offer into evidence. Exhibits shall be pre-marked using Arabic numbers. The Department’s exhibits shall commence with the number 38.

3. The Protective Order of April 5, 2010 remains in effect.
